India’s top court strikes down colonial-era law against gay sex

India’s top court has decriminalised gay sex, striking down a colonial-era law, sparking jubilation among LGBTQ and human rights groups across the country.

The Supreme Court in Delhi ruled that the Section 377 law, dating from 1861, was unconstitutional.

The Bollywood director and producer Karan Johar, who has long campaigned for gay rights, tweeted: “… abolishing #Section377 is a huge thumbs up for humanity and equal rights! The country gets its oxygen back!”

The five-member bench said the concept of “I am what I am” must be be protected under Indian law, referencing the 18th century German philosopher Johann Wolfgang von Goethe.

Chief Justice Dipak Mshra added that homosexuality is neither a crime nor a “mental disorder” as described in the “incomprehensible” 157-year-old laws.

Justice Chandrachud, reading out the verdict, said: “Section 377 provided ‘rule by the law’ instead ‘of the law’.

"Sexual minorities in India have lived in fear, hiding as second class citizens," he said.

“The constitution protects the fluidity of sexual experience,” he added, saying that overturning Section 377 was a big step towards “laying the colonial ghost to rest”.

“This is not just a major landmark but some of the language coming out from the court is just beautiful” said the author Chetan Bhagat, an outspoken proponent for gay rights in India. “It feels like we have been on the journey here together: the people and the judges, and that the journey continues.”

The Supreme Court verdict comes after a petition by five openly gay people, who claimed they were facing harassment and intimidation under the laws. They were: dancer Navtej Singh Johar, journalist Sunil Mehra, restaurateur Ritu Dalmia, hotelier Aman Nath and businesswoman Ayesha Kapur.

"Sexual orientation is one of many biological phenomena which are described as natural and inherent. They are considered part of freedom of expression”, the judgment said. “The fundamental rights of even a single individual cannot be infringed upon."

The Court said that all measures should be taken to properly broadcast the fact that homosexuality is not a criminal offence any more, to create public awareness.

Section 377 has been through legal wrangles since 1994, with parliament and the judiciary batting the issue between each other. It was ruled unlawful before it was reinstated in 2014 after a challenge by ultra-religious groups.

French authorities ban parents from calling baby boy ‘Amber’ 

French authorities have refused to let a couple name their newborn boy Amber because the child might suffer from unclear sexual identity.

Amber – or Ambre in French – has now joined a growing list of names such as Nutella, Strawberry, and Manhattan that have fallen foul of French courts who deem them unsuitable and potentially damaging.

The couple from the Morbihan department of Brittany had the child in January this year. But when they went to officially register his birth, the registrar reported them to the prosecutor in the town of Lorient, who decided that as Ambre was usually a girl’s name the risk of confusion over the child’s sex might prove damaging to him.

The parents were ordered to appear in a family court but the judge said she saw no grounds for forcing them to change their child’s name. The prosecutor however decided to appeal, and the baby’s name will remain in limbo at least until next April when the case is likely to come back before the court.

The child’s mothers, who are backed by Les Enfants d’Arc-en-Ciel, a group promoting the rights of gay parents, have questioned whether they are the victims of homophobia.

“Society is very unfair,” said one of the boy’s mothers Alice Gondelle. “It allows ridiculous first names like ‘Clitorine.’ I wonder why it is that with a name as classic and ancient (as Ambre) can’t get through and it is the state that is attacking us in the courts?” 

Amber, which is derived from the translucent fossil resin used in jewelry making, is a popular girl’s name in English-speaking countries, especially the United States, but its French equivalent Ambre is relatively rare in France. It is largely seen as a female name, but Ms Gondelle said in a post on her Facebook page that she knew of 37 male Ambres in France.

French officials have a long track record of knocking back names they do not approve of. In 2015, a court ruled that a couple could not call their daughter Nutella as it might “lead to mockery and unpleasant remarks.” The same court had made similar arguments a few months earlier before overturning the decision of another couple to name their child Fraise (Strawberry).

Last year a couple was told to find another name for their baby after a court ruled they could not use the name they wanted because it contained the an accented letter, “ñ”.

The French language does not use the tilde accented, but the couple from Brittany had picked a traditional but obscure name from the Breton language – Fañch.

NJPW 45th Anniversary show results: LIJ vs. Chaos six-man main event

The Big Takeaway —

The build towards the New Japan Cup continued as those who were scheduled to face off against one another in the opening rounds competed in a series of mystery tag team matches. The situation over the NEVER title became clearer, as Zack Sabre Jr. looks to add a fourth belt to his growing collection.

Gedo & Jado have become the favorites to get the next Junior tag team title match against new champions Taichi & Yoshinobu Kanemaru. KUSHIDA scored a pin over Hiromu Takahashi, further building a showdown between the two.

Manabu Nakanishi, Hirai Kawato, Ryusuke Taguchi & David Finlay defeated Jushin Thunder Liger, Tomoyuki Oka, and IWGP Tag Team Champions Hiroyoshi Tenzan & Satoshi Kojima

Kawato jumped Liger at the bell and really gave him a beating, stomping him in the corner viciously. This was a standard, pretty solid opener with Nakanishi scoring the win with the torture rack on Oka.

Kawato and Liger stared down one another after the match, but nothing came out of it. 

Yuji Nagata, Juice Robinson & Michael Elgin defeated Yujiro Takahashi, Bad Luck Fale & Tanga Loa

Juice and Yujiro, who are facing each other in the opening round of the NJPW Cup, squared off against one another, as did Elgin and Fale. It boiled down to Nagata and Loa, with Nagata drilling his NJ Cup opponent with an exploder suplex for the win. This was a nice match with some good action.

RPW British Heavyweight Champion Zack Sabre Jr., El Desperado, and IWGP Junior Heavyweight Tag Team Champions Taichi & Yoshinobu Kanemaru defeated NEVER Openweight Champion Hirooki Goto, Jado, Gedo & Trent Baretta

This was a solid match, but it was more about building programs for the NEVER and Jr. tag team titles. The heels beat up on Gedo for a while. They were building a future junior tag title bout between the new champs and Gedo & Jado.

Goto and Sabre Jr. were paired together and went at it for a bit, exchanging near falls before Sabre Jr. caught Goto in a bridge pin hold. This probably signals a future match between Goto and Sabre Jr. for the NEVER title.

Tiger Mask, Katsuyori Shibata & Togi Makabe defeated Minoru Suzuki, Taka Michinoku & Davey Boy Smith Jr.

Suzuki and Shibata brawled into the crowd early, with Suzuki getting the better of it and whacking Shibata with a steel chair. Suzuki and Shibata eventually came back in. Both teased their finishers but took each other down with multiple big boots. The crowd was really into that, and helped the match pick up over time.

Makabe and Taka Michinoku were in, and from there it didn’t last long as Makabe quickly took him down and pinned him with the King Kong Knee Drop.

Shibata and Suzuki continued to brawl as they eventually had to be separated. Suzuki pelted one of the young boys (Kitamiya) with a steel chair, causing another brawl between the two. 

Kenny Omega & Tama Tonga defeated Toru Yano & Tomohiro Ishii

Yano had a near fall with a low blow on Tonga, but Omega pulled the ref out. Omega went for the knee strike, but Yano dodged and Omega fell to the floor. Tonga gave Yano a low blow of his own, then pinned him with the Gun Stun in another solid match.

KUSHIDA & Hiroshi Tanahashi defeated EVIL & IWGP Junior Heavyweight Champion Hiromu Takahashi

Tanahashi jumped EVIL at the bell, which was retaliation for EVIL’s assault earlier in the day at the New Japan Cup press conference. Hiromu Takahashi and KUSHIDA worked together a lot as well, since they are the next Junior title match. They have excellent chemistry with one another and made this a good match.

EVIL laid out Tanahashi, then KUSHIDA sent EVIL packing. KUSHIDA then caught the surprise win over Takahashi with a backslide into a bridging pin. 

IWGP Intercontinental Champion Tetsuya Naito, BUSHI & SANADA defeated YOSHI-HASHI, Rocky Romero & IWGP Heavyweight Champion Kazuchika Okada

Not a spectacular main event by any means, but the action was fine and the crowd was pretty hot for everything, which helps.

BUSHI wiped out YH on the outside, leaving it between SANADA and Romero. The latter pulled off some great near falls that people got into, but the size difference was too much and Romero tapped out to the Skull End when SANADA sunk it in.

Final Thoughts —

There’s nothing on this show that you need to see, though everything was solid and nothing was awful.

European golf champion murdered in US college town

A star collegiate golfer from Spain was attacked and killed by a homeless stranger while she was playing a round alone near her campus in Iowa, police said Tuesday.

Celia Barquin Arozamena, who was working toward joining the pro tour while finishing her degree at Iowa State University, was stabbed by the assailant Monday morning and left dead in a pond on the golf course, police said. Her body was found after fellow players saw her abandoned golf bag.

Collin Daniel Richards, a 22-year-old with a history of violence, was arrested and charged with first-degree murder. Investigators said Richards had told an acquaintance he had "an urge to rape and kill a woman" and that he was living in a homeless encampment near the golf course in Ames, about 30 miles (50 kilometers) north of Des Moines.

Police said they recovered a knife and bloody clothing linked to Richards, who completed a prison sentence in June and has prior convictions for burglary and harassment.

Barquin was remembered as one of Iowa State’s most accomplished golfers and a bright engineering student. This year, she won the Big 12 championship and an amateur tournament in Europe and competed in the US Women’s Open Championship.

"Losing one of our student-athletes is like losing a child," Iowa State athletic director Jamie Pollard said, choking back tears at a news conference. "We’re all devastated and heartbroken."

Pollard said Barquin had "broke down in tears" when she found out she had been named the school’s 2018 female athlete of the year – an achievement she had been set to be honored for during Saturday’s football game. Instead, the team will wear helmet decals with Barquin’s initials to honor her.

Ames Police Cmdr. Geoff Huff said homicides are rare in the city, and it’s "very troubling for something like this to happen in broad daylight."

It’s the second fatal stabbing of a female college student in Iowa in recent months. An immigrant from Mexico is charged in the July slaying of University of Iowa student Mollie Tibbetts, who vanished while out for a run in the town of Brooklyn.

Police were called to Coldwater Golf Links around 10:20 a.m. Monday to investigate a possible missing player after golfers found her bag and no one around it. Officers found Barquin’s body with several stab wounds to her upper torso, head and neck, according to the complaint filed Tuesday against Richards.

A police dog tracked Barquin’s scent to a homeless encampment near the course where Richards had been living in a tent, the complaint said. Officers found Richards with several scratches on his face consistent with fighting and a deep laceration in his left hand that he tried to conceal, it said.

"What did he do to her?" an acquaintance of Richards allegedly asked officers who were searching the area.

That man told investigators Richards had said recently he had "an urge to rape and kill a woman" while they were walking near the course, the complaint said. A second acquaintance told police that Richards arrived at his nearby home Monday "disheveled and covered in blood, sand and water." He bathed and left with his clothes in a backpack.

Investigators later recovered shorts with blood stains and a knife that Richards allegedly gave to two other people after the slaying, the complaint said. Those two individuals were driving Richards out of town, but he asked them to drop him off near the camp so he could get his tent.

Huff said no one else had been charged, but that the investigation was ongoing.

Professional golfer Sergio Garcia, a native of Spain and one of Barquin’s favorites, tweeted that he was heartbroken by the news, saying he’d had the pleasure of meeting Barquin and calling her a "special person."

A judge ordered Richards jailed on a $5 million, cash-only bond during a court appearance Tuesday.

Richards, who faces life in prison if convicted, reported in a financial affidavit that he has no job. Paul Rounds, a public defender assigned to represent him, filed paperwork asserting that his client didn’t wish to speak to investigators.

Barquin, a native of Puente San Miguel, Spain, was finishing her civil engineering degree this semester after exhausting her playing eligibility in 2017-2018, according to the university .

She was one of the most accomplished golfers in school history. In April, she became the second women’s golfer at Iowa State to earn medalist honors at a conference tournament when claiming the 2018 Big 12 Championship with a three-shot victory.

Barquin, who was ranked No. 69 nationally by Golfweek, ended her collegiate career with a fourth-straight NCAA Regional appearance and earned All-Big 12 Team honors for the third time. She was the third Iowa State women’s golfer to compete in the U.S. Women’s Open Championship.

Her former team announced Tuesday it was pulling out of the East & West Match Play in Ann Arbor, Michigan, to be with friends and family and to grieve their loss. Women’s golf coach Christie Martens said Barquin was an "outstanding representative of our school."

"We will never forget her competitive drive to be the best and her passion for life," Martens said.

Richards left prison in June after serving seven months for violating the terms of his probation, following convictions for burglary, theft, criminal mischief and harassment, according to the Iowa Department of Corrections. Records show he was arrested weeks later after he was found passed out near an Ames liquor store, telling police he took antidepressants before drinking alcohol.

Since 2014, Richards had been charged with abusing a girlfriend, stealing a pickup truck, using a baseball bat to smash a car window and burglarizing a gas station. In one case, the Iowa State Patrol seized a long knife from him during a traffic stop. In another, he threatened to return to a convenience store to shoot clerks who caught him shoplifting.

For the first time since July’s lackluster Battleground show, SmackDown will put on a brand-exclusive pay-per-view as Hell in a Cell takes place in Detroit on Sunday night. Battleground was a night where nearly everything went wrong. The Punjabi Prison main event was awful, AJ Styles vs. Kevin Owens had a botched finish, and only the tag title match between The New Day and The Usos saved it from being a totally irredeemable show.

Lance Russell, who passed away on 10/3, at the age of 91, was the greatest host of a pro wrestling show that there ever was, or ever will be.

But that was secondary. Lance Russell was, as much as anyone I’ve ever encountered, a wonderful human being. To several generations in Memphis, as well as in cities throughout Tennessee and Kentucky, he was not just the lead wrestling announcer on Championship Wrestling, but, even if you didn’t know him personally, or had never met him, he was like an uncle, or the cool neighbor that you loved hearing tell stories about his most interesting life, or, as he got older, like another grandfather to kids that grew up watching wrestling. That was for the people who didn’t know him.

To those who did, he was, put succinctly, “Lance is a very special person,” in the words of Dave Brown, whose life he shaped when 50 years ago he offered him a job as his sidekick calling wrestling, which led to a career as the most popular television news personality in the Memphis market for decades.

THURSDAY NEWS UPDATE

Today is the 20th anniversary of the death of Brian Pillman. I will be doing a podcast with Chris Jericho that drops tomorrow on the Talk is Jericho show covering Pillman.

In addition, it was announced today that a biography called Crazy Like a Fox: The Definitive Chronicle of Brian Pillman 20 Years Later” will be released later this month on Amazon. The book covers Pillman’s personal and professional life with interviews with members of the Pillman family, myself, Kim Wood (a former coach of the Cincinnati Bengals who was like his father figure), Bruce Hart Raven, Jim Cornette, Mark Madden and Les Thatcher.

Bellator announced today that they will have four fights on 10/13 at the infield of the Talladega Superspeedway in Talladega, AL in conjunction with he Monster Energy NASCAR Cup Series Playoffs. The fights will take place at 8:30 p.m. Central time in the infield after the Big One no the Blvd. parade and party. There will also be a Friday afternoon meet and greet with Roy Nelson and Michael Chandler from 3-4 p.m.

The lineup will be:

UFC announced a partnership with Bodyarmor Sports Drink as the official sports drink of the UFC.
Mauricio Shogun Rua underwent surgery yesterday on his left knee in Sao Paulo, Brazil. Rua suffered the knee injury that forced him out of the 9/23 event in Saitama, Japan, where he was originally to face Ovince Saint Preux in the main event.
A fight with welterweights Chris Gruetzemacher vs Davi Ramos was added to the 12/9 show in Fresno. 
Chase Sherman vs. Shamil Abdurakhimjov in a heavyweight fight has been added to the 11/25 show in Shanghai, China.
Zabit Magomedshapirov, who looked great in his debut in September, will return to face the debuting Sheymon Moraes also on the 11/25 show in Shanghai, China.
Neil Magny vs. Carlos Condit in a battle of top welterweights will be on the PPV show most likely for 12/30 in Las Vegas.
MISCELLANEOUS
ROH announced that there will be meet and greets at all four house shows next week, 10/12 in Buffalo at RiverWorks, 10/13 in Pittsburgh at Stage AE, 10/14 in Columbus, OH at ExpressLive and 10/15 in Chicago at the Odeum Expo Center. The top names like Young Bucks, Kenny Omega, Minoru Suzuki, the Killer Elite Squad, Will Ospreay, Hiromu Takahashi, Yoshi-Hashi, Kushida, Bully Ray and Toru Yano will be signing at all shows. There will be both pre-show signings and signings at intermission.
Bellator will be giving away Royce Gracie bobbleheads to the first 5,000 people who attend its 10/20 show in Uncasville, CT at the Mohegan Sun Casino. Gracie will also be doing a meet and greet at the concourse of the Mohegan Sun from 6:30 p.m. to 8:30 p.m. that night. The show that night is headlined by Gegard Mousasi vs. Alexander Shlemenko and Brennan Ward vs. Dave Rickels.

Former French PM Manuel Valls running for mayor of Barcelona on anti-independence ticket

Manuel Valls, the former French prime minister and a vocal opponent of Catalan independence, on Tuesday night announced his candidacy for mayor of Barcelona, setting off a fierce contest for control of the city deemed central to secessionist ambitions.

The Barcelona-born politician, who has dual nationality through his Catalan father, said he would run as an independent though noted the backing of the conservative party Ciudadanos, the leading pro-union force in the autonomous community. Others would join them, he hoped.

“I want to be the mayor of a new Barcelona, for everyone,” Mr Valls told a packed press conference in the city, which he said should be “the antidote to populism”. 

Barcelona was today suffering “serious problems” including crime, poor management of tourism, and effects of the independence process. Citing the flight of businesses and social tensions, Mr Valls said the city “deserved to be governed in its own interests”, adding “Barcelona has to go back to being Barcelona”.

He said he would next week resign his duties in France, where he represents a constituency in Essone, describing his move to Barcelona as "an act of faith" in a city that had always held a treasured place in his family life.

Teased by Mr Valls for months, the announcement has galvanised pro-independence parties, who regard Barcelona’s City Hall as a key battleground in the fight for a Catalan Republic. The current mayor, Ada Colau of the left-wing Barcelona en Comú, supports Catalan self-determination but has been critical of unilateral secessionist moves.

Amid a flurry of negotiations over potential candidates and coalitions, the left wing, pro-independence Esquerra Republicana (ERC) has now pinned its hopes on Ernest Maragall, the veteran political heavyweight who is currently the Catalan councillor for exterior relations. 

Mr Maragall’s selection came at the expense of Alfred Bosch, the ERC council leader who at the weekend announced he was stepping aside in favour of the “better candidate”. 

The ERC politician has already gone on the offensive against Mr Valls, on Monday branding him the "candidate of the rich, but not only those of Barcelona" and suggesting his campaign is being directed from "outside" the city.

Mr Maragall has also raised the possibility of joining forces with Ms Colau in order to see off the challenge from Mr Valls. 

Despite increasing local criticism over spiralling living costs, tourism management and security, Ms Colau remains popular, with recent polls indicating a repeat of her 2015 victory – albeit a narrow one.

But the star power of Mr Valls, combined with rising local support for Ciudadanos, could prove a formidable challenge.

Led in Catalonia by Ines Arrimadas, Ciudadanos capitalised on anger among opponents of independence to become the largest single party in the Catalan parliament in last December’s snap elections, though the separatist coalition retained overall control.

PdeCat, the party of pro-independence leader Carles Puigdemont, would like to maintain that alliance in the May 26 vote. But disagreements between secessionist parties on the path towards a Republic, as well as divergent ideologies on other issues, could prevent such a pact.

Diesel develops denim fabric capable of halting viral activity

As brands and retailers respond to the COVID-19 crisis, Diesel has
found a new way to contribute to ending the pandemic. The denim label
has developed an innovative fabric that can physically halt 99 percent
of viral activity.

Created in partnership with Swedish firm Polygiene, Diesel retains
exclusive use of the new ViralOff treatment on denim. The brand will
implement ViralOff across a selection of its Spring/Summer 2021
styles, with the aim to include it in an even wider range moving
forward.

Polygiene began working on garment protection with the SARS
epidemic in the early 2000s, with ViralOff serving as a result of its
efforts. The fabric technology has the capacity to disable at least 99
percent of viral activity within two hours of contact between
pathogens and the fabric. It works by interaction with key proteins
that prevent the virus from attaching to textile fibers. The treatment
has proven to be effective against a range of viruses including
COVID-19.

Diesel will treat a selection of denim models with ViralOff during
the final production stages.

Jackrabbits Earn Academic Recognition

OREM, Utah — A total of 15 South Dakota State University wrestlers received recognition from the Western Wrestling Conference on either the All-Academic Team or Coaches’ Honor Roll during the recently completed 2014-15 season.

The Jackrabbits, coached by Chris Bono, placed seven wrestlers on the All-Academic Team, tying North Dakota State for the most selections in the six-team conference. SDSU honorees included:

To qualify for the All-Academic team, student-athletes had to secure a minimum 3.20 cumulative grade point average, as well as be a starter or key reserve.

In addition, eight other Jackrabbit wrestlers earned distinction as a member of the Coaches’ Honor Roll for maintaining a minimum cumulative GPA of 3.0 or higher. SDSU’s Coaches’ Honor Roll selections included:

SDSU’s 15 total selections ranked second among league members, trailing Utah Valley’s 18 honorees. In all, 71 student-athletes were recognized on the two academic honor squads from the Air Force Academy, North Dakota State, Northern Colorado, SDSU, Utah Valley and Wyoming.

DuLaney transfers from UNI to Iowa Lakes

Two-time state finalist Christian DuLaney is transferring from the Universty of Northern Iowa to Iowa Lakes Community College for the upcoming season. DuLaney placed second at 220 pounds as a senior in 2014 for Benilde-St. Margaret’s. He was runner-up at 182 pounds as a junior. DuLaney completed his redshirt season (7-9 record at 197 pounds) at UNI this past year and will be ready to compete for Iowa Lakes this fall.

“We are excited to have Christian join us,” said Iowa Lakes Coach Cody Alesch. “We recruited Christian hard coming out of high school and believe he has a lot of potential. He is a great young man and my expectations are high for Christian both academically and on the wrestling mat. I think he will be a great fit here at Iowa Lakes.”
